Full document checks for permanent residence permits in Bulgaria: what has changed and how to prepare

Obtaining a permanent residence permit in Bulgaria on the grounds of origin (Bulgarian roots) has become a stricter and more formalised procedure. The new amendments to the Правилник к ЗЧРБ make the process more transparent for the state, but at the same time raise the requirements for applicants. We look at what to pay attention to in order to reduce the risk of refusal.

The main change: mandatory examination of documents

Whereas previously the authenticity of birth certificates could be checked selectively, now every document undergoes a mandatory examination.

The migration authorities may check:

  • the quality of the paper and the stamps
  • whether the forms and details match the period of issue
  • the presence of corrections
  • the data through official enquiries to archives and civil registry offices in other countries

In practice this means that even old documents “from the family archive” are now examined as critically as possible.

Critical area: any alterations in the birth certificate

The condition of the birth certificate has become one of the key factors. Under the new practice:

  • Any corrections, crossings-out or erasures (even official ones, if they are not drawn up in full compliance with the rules and not certified by the authority) may become automatic grounds for refusal.
  • Even a minor alteration may be treated as a “red flag” and cast doubt on the reliability of the entire document.

It is important to understand the authorities’ logic: better to refuse than to accept a potentially unreliable document.

Can a refusal be appealed

Court practice currently remains contradictory:

  • In some cases the courts side with applicants if Bulgarian origin is confirmed by a body of other documents.
  • In others they fully uphold the refusal by Migration because of the “improper appearance” of the primary document.

There is as yet no single standard for such decisions, which means that a court appeal involves risk, time and additional costs.

Practical advice for applicants

If your birth certificate:

  • contains corrections
  • looks worn
  • is hard to read
  • contains unclear stamps or entries

It is better to obtain a duplicate (a re-issued certificate) in advance.
A modern duplicate with no alterations or damage significantly reduces the questions raised during the examination.

The procedure for a permanent residence permit on the grounds of origin in Bulgaria is becoming more formal and more demanding as to the quality of documents. Preparation and “document hygiene” now play a decisive role.

The sooner you check and put your documents in order, the higher your chances of completing the procedure without unnecessary refusals and court disputes.
