OBTAINING A RESIDENCE PERMIT
IN BULGARIA BY PERSONS UNDER
SPECIAL PROTECTION OF THE STATE

In accordance with Art. 24, para 1, sub-para 17 of the Bulgarian law on Foreigners Residence permit in Bulgaria can be obtained by persons who are under special protection of the state. The right to this protection can be obtained in accordance with the Law on Combating Trafficking in Human Beings.

WHAT DO YOU HAVE TO DO?

In accordance with Art. 25 of this law, persons who have become victims of human trafficking and who have agreed to cooperate with the authorities in order to catch criminals are entitled to receive special protection status for the entire duration of the investigation. The status of "special protection" includes the opportunity to stay in a special shelter and the granting of a permit for a long stay in Bulgaria. Within three days after the receipt of the application from the victim of trafficking in persons, the prosecutor issues an appropriate act granting her special protection status. This act serves as confirmation of the grounds for obtaining a residence permit. During the period of permitted stay in Bulgaria, such persons enjoy the same rights as other holders of a residence permit, with the exception of the right to leave Bulgaria and enter it without a visa. To obtain a residence permit on this basis, you must also have identity documents or at least provide assistance in establishing your identity.
In this case, to obtain a residence permit, you need to contact the migration service directly and provide:
  • applicxation;
  • a letter from the competent state body confirming the existence of the circumstances for granting the status of special protection;
  • document confirming the paid fee (10 levs).

  • The period during which a foreigner can stay in Bulgaria is determined individually. In some cases, a person may lose special protection status. For example, if it renews contacts with criminals, whose capture it promised to assist, or poses a danger to public order and security. In this case, the basis for a long stay in Bulgaria may be lost.
