OBTAINING PERMANENT RESIDENCE
BY FOREIGNERS, WHO WERE IN BULGARIA
BEFORE 27.12.1998, AND WHOSE PARENTS
HAVE A MARRIAGE WITH BULGARIAN CITIZENS

Article 25, para 1, sub-para 10 of the Bulgarian Law on Foreigners provides for the possibility of obtaining permanent residence by foreigners who, prior to December 27, 1998, entered the territory of Bulgaria, stayed or were born on it, provided that their parent married a citizen of Bulgaria.

WHAT DO YOU HAVE TO DO?

First you need to get a long-term visa and cross the Bulgarian border with it. Then, during the validity period of the visa, to obtain permanent residence, you must personally appear at the Migration Directorate at your place of residence. This must be done at least two months before the expiration of the visa, which is issued for 180 days.

At the migration service, you need to fill out the appropriate application and attach to it:
  • Foreign passport valid for at least three more months and simple copies of spreads with photos and personal information, as well as a stamp about the last crossing of the Bulgarian border;
  • Proof of having a place to live (own or rented housing);
  • A bank certificate confirming that the applicant has funds to live without resorting to social assistance;
  • A certificate of no criminal record obtained at home or in the state of usual residence no earlier than 5 months before the submission of documents. The certificate must be translated and legalized. Stateless persons do not provide such a certificate;
  • Receipt of payment of the fee for the examination of the application (10 levs);
  • Documents confirming the ground.
    Since in this case two conditions must be met at once, the ground for obtaining permanent residence in Bulgaria is confirmed by three documents. It:
  • Applicant's birth certificate (original and simple copy);
  • An official document certifying the fact that the applicant was on the territory of Bulgaria before 27.12.1998;
  • Certificate of marriage between the parent of a foreigner and a citizen of Bulgaria.

If the birth certificate is issued outside Bulgaria and is not in Bulgarian, then it must be translated and legalized. If, however, documents certifying birth and marriage were issued in Bulgaria and are reflected in the state database "Population", then the foreigner may not provide them when applying to the migration service. To obtain a Visa D, the same documents are required, except for the receipt of tax payment. Additionally, you need to get health insurance for foreigners with coverage of at least 60 thousand levs for the duration of the visa. The bank account must have at least 6 Bulgarian minimum wages (in 2020, the minimum wage is 610 leva). The decision on the application for permanent residence is made within two months. If necessary, employees of the migration service can request additional documents and extend the period for another two months. If the permit is issued, the foreigner must pay the state fee in the amount of 1 thousand leva within three days. After that, one should register with the Community at the place of residence to obtain a single civilian number and order a personal card from the migration service. It is produced within 30 days, costs 45 levs and is valid for five years. After this period, you will need to get a new card.
